“Scene don’t work for free”
It’s been ~35 years since I cracked games but we most certainly did everything “for free” back then (or, “for bragging rights” as it were).
I seriously doubt things are that much different now. I’d wager you’re one step removed from “the scene” and only seeing shady repacks from scammers.

What the Law requires for an inventive step?
a patent shall not be granted for an invention where a person ordinarily skilled in the art could have been easily make the invention based on the prior art at the time of filing. Free legal advise to Nintendo:
A patent may not be obtained though the invention is not identically disclosed or described as set forth in section 102, if the differences between the subject matter sought to be patented and the prior art are such that the subject matter as a whole would have been obvious at the time the invention was made to a person having ordinary skill in the art to which said subject matter pertains. Patentability shall not be negatived by the manner in which the invention was made.
IIRC when Tramiel bought Atari their vision was all about the 16/32 bit computers but did quite a few things to bring in cash based on the existing Atari designs - and chips. That’s the Atari 65 and 130XE too just being rehashes of older 8 bit Bushnell computers.
I’m all Tramiel-Atari era myself so never even reflected on the 8 bit re-releases though so I might be misremembering something.

When a games developer make a game for Switch Nintendo has a say in how it must perform before you’re allowed to release it. Valve have no such requirements on games put on Steam - it’s up to the developers whether to require a lot of performance or not. Thus, while Valve sells the Steam Deck that doesn’t mean games on Steam necessarily run well on it.

Nintendo can make sure their handheld has affordable hardware yet can play all their AAA games as they were meant to. Steam Deck can’t ever have that luxury. Some Steam Deck makers will make expensive ones that can play most of them, some will make cheaper ones that aren’t made for those games at all.
This is very difficult to explain to the casual buyer (think parents buying as a present for their kids).
